@mv everyone could potentially file in small claims court. A judicial denial of service of the government attorney sounds interesting, but seems like a waste of a lot of time. I'd also be concerned about rule 11 sections for filing out of spite...though rule 11 implies fed court -

@mv I do not know the details of section 1983. There may be some statutory damages but looking at it through general torts/contracts damages, I don't see a protestors getting much. -

@mv my assertion is not that cities and states do not violate the constitution but rather that the courts are available to anyone that has had their rights violated. Luckily there section 1983 that means that if you win the state pays the legal bill. -

@mv and strict scrutiny, while hard, is not impossible to pass. Japanese detention was held up under strict scrutiny. The courts don't like to meddle with the military or police. -

@mv the problem with a protest is each protest is different, so getting an injunction after the fact is pointless, if a court would even hear it (and I'd suggest they shouldn't ) -
