   for instance, method patents by surgeons (I think it's just surgeons) can't be enforced, but I think building "exceptions" misses the mark on how different industries are. As an aside, method patents in general are pretty stupid if you ask me.

   due to all the FDA regulations, individuals and small businesses aren't capable of entering the drug market as it is, so a trademark-like system wouldn't really change anything for them.

   but you make me think of something I mentioned to @snapl a couple of weeks ago with respect to copyright. I wonder if thinking of "copyright" and "patent" is really not the best system but rather whatever protections we as society want to give should be more tailored toward art

   I believe I mentioned getting rid of an examination process. That system is based primarily on Copyright. This proposal is more like Trademark and, as proposed, is clearly unconstitutional (unless was strictly formulated as trademark).

   What do people think of a perpetual patent system where improvements are *NOT* subject to the blocking patent. This means drug companies do not need to recoup costs quickly and thus can reduce initial cost. It essentially turns a patent into a trademark.
