my guess is "counterfeit" goods are probably going to be tried under the Unfair Business legislation or "Consumer Protection" - http://www.lexadin.nl/wlg/legis/nofr/oeur/lxwemis.htm - I feel like that's probably far enough down this rabbit hole. :) -

I don't know exactly what observer status means for TRIPS, but I think it is possible to not make the hitlist and not actually sign any international agreements. -
