perhaps north of the border legislation has a different meaning, but here "Legislation refers to the preparation and enactment of laws by a legislative body through its lawmaking process," not the Constitution. Constitutional Amendments have a different process. -

This whole gun thing could be solved pretty easily I think with the Amendment "The Second Amendment shall not be incorporated into the Fourteenth Amendment against the states." Done and done. Keep the feds off your back, but if states want, they can pass gun laws. -

I guess there is a distinction that Lawrence v Texas was a criminal matter and DOMA is simply ministerial in some sense, but that seems like a pretty weak distinction. -

the courts don't need to be in step with the majority to be right. I actually think the 9th Circuit is "right" in some sense of the word, but I have a feeling SCOTUS will say it's semantics. -

all this talk about clearly unconstitutional (at least based on SCOTUS interpretation) has me thinking about DOMA. I have a feeling that DOMA falls and Prop 8 gets upheld. It's never smart to bet on the 9th Circuit. -
